Application deadline for LMWD board election approaches

The Laguna Madre Water District will be holding an election to fill three positions on the board of directors.
The open positions are Director Position No. 2, Director Position No. 3 and Director Position No. 4.
The election will take place on Nov. 5, 2024. The application window to be put on the Laguna Madre Water
District Regular Election Ballot opened July 20 and closes Aug. 19 at 5 p.m.

The physical address for filing applications in person for a place on the ballot is Laguna Madre Water District 105 Port Road Port Isabel, Texas 78578. The LMWD office is open from 8 a.m. – 5 p.m. Applicants can also file by mail to the same address.

Applications may be obtained online at lmwd.org. To qualify, applicants must be at least 18 years old, a Texas
citizen and either own land subject to taxation in the district or be a qualified voter within the district.
The responsibilities of the Board of Directors include developing policy, understanding state and federal
regulations, setting goals and objectives and planning on how to achieve them, budgeting, management, monitoring system performance, and ensuring there are emergency measures in place if a crisis arises.
Directors must attend board meetings which occur twice a month.

Directors are also subject to the provisions of Chapter 171, Local Government Code, relating to the regulation of conflicts of interest of officers of local governments, which reads as follows:
a) If a local public official has a substantial interest in a business entity or in real property, the official shall file, before a vote or decision on any matter involving the business entity or the real property, an affidavit stating the nature and extent of the interest and shall abstain from further participation in the matter if:

(1) in the case of a substantial interest in a business entity the action on the matter will have a special economic effect on the business entity that is distinguishable from the effect on the public; or
(2) in the case of a substantial interest in real property, it is reasonably foreseeable that an action on the matter will have a special economic effect on the value of the property, distinguishable from its effect on the public.

The affidavit must be filed with the official record keeper of the governmental entity. If a local public official is required to file and does file an affidavit under Subsection (a), the official is not required to abstain from further participation in the matter requiring the affidavit if a majority of the members of the governmental entity of which the official is a member is composed of persons who are likewise required to file and who do file affidavits of similar interests on the same official action.
